Who is liable for faulty certificates?
As a certified trust service provider, Swisscom Trust Services guarantees unlimited liability for incorrect issues of qualified certificates by law. In the case of advanced certificates, Swisscom can limit liability and has compulsory insurance.
Suppose a signing application displays errors in a certificate while exchanging a document hash with Swisscom's Signing Service, or a delegated registration authority makes errors in the identification and registration. In that case, Swisscom will hold these third parties liable.
To avoid liability risk, Swisscom demands high requirements for the issuance and contract process of certificates or requires a possible audit of all parties involved.
